ENGEL, Circuit Judge. The Board of Education of Lauderdale County, Tennessee, and the Superintendent of Schools appeal from a judgment entered in the United States District Court for the Western District of Tennessee awarding reinstatement, backpay and attorneys fees to Clarence E. Keeley. Following a non-jury trial the district court found that the school authorities had fired Keeley not because he is black, but in retaliation for his filing a charge of race discrimination with the EEOC. The court concluded that the Board had violated section 704(a) of Title VII of the Civil Rights Act of 1964, 42 U.S.C. ? 2000e-3(a) (1976), and section 1 of the Civil Rights Act of 1866, 42 U.S.C. ? 1981 (1976).
